Terms and Conditions

These terms and conditions of sale govern the sale of products marketed by FATTORIA MAJNONI GUICCIARDINI DI PIETRO MAJNONI E FIGLI SSA (hereinafter referred to for brevity as Majnoni.com) through www.majnoni.com . All contracts for the purchase of products concluded, through the site and in accordance with the procedures indicated therein, between the seller and the Customer, will be governed by these terms and conditions of sale (in accordance with Italian law and in particular with Legislative Decree 70/2003 with regard to electronic commerce and Legislative Decree 206/2005 with specific reference to the legislation on distance contracts). Any changes or new conditions of sale will be promptly reported to the Customer, will be effective upon publication on the site, and will apply only to sales completed after publication.

Acceptance of terms of sale

The contract entered into between Majnoni.com and the Customer shall be deemed concluded upon Majnoni.com’s acceptance of the order. Acceptance shall be deemed tacit unless otherwise communicated in any manner to the Customer. By placing an order in the various ways provided, the Customer declares that he/she has read the instructions given during the purchase procedure and accepts the conditions transcribed below. The Customer is therefore urged to read these terms and conditions carefully and print them out or save them on another durable medium accessible to him.

Mode of purchase

The Customer may purchase only the products on the website www.majnoni.com at the time of placing the order as described in the relevant information sheets.

FATTORIA MAJNONI GUICCIARDINI DI PIETRO MAJNONI E FIGLI SSA reserves the right to change product information to accommodate changes in products without prior notice.

The pictures on the site are provided to the Customer to facilitate product recognition, due to variations in packaging by the manufacturer, the pictures may not accurately reflect the appearance of the delivered product.

Correct receipt of the order is confirmed by FATTORIA MAJNONI GUICCIARDINI DI PIETRO MAJNONI E FIGLI SSA by an e-mail reply, sent to the e-mail address provided by the Customer. This confirmation message will contain the date and time of receipt of the order and an “Order Number”, to be used in any further communication with FATTORIA MAJNONI GUICCIARDINI DI PIETRO MAJNONI E FIGLI SSA, as well as a reference to these conditions of sale. In case of non-acceptance of the order, FATTORIA MAJNONI GUICCIARDINI DI PIETRO MAJNONI E FIGLI SSA undertakes to promptly notify the Customer.

All prices on the site are intended to be public prices and, therefore, include vat. FATTORIA MAJNONI GUICCIARDINI DI PIETRO MAJNONI E FIGLI SSA reserves the right to change prices at any time, without prior notice.

Methods of payment

The Customer can purchase products on www.majnoni.com using different forms of payment as indicated in the purchase procedure. Any additional costs pertaining to a particular payment method will be explicitly highlighted during the purchase process itself.

Mode of delivery

FATTORIA MAJNONI GUICCIARDINI DI PIETRO MAJNONI E FIGLI SSA delivers its products through specialized couriers. Shipping costs, in general, are the responsibility of the Customer and are explicitly highlighted when the order is placed. Depending on the destination area of the goods, deliveries may be made within 24 hours to 4 days, subject to setbacks (however, no later than 30 days from the date of the order). The Customer upon receipt of the goods is required to check the integrity of the goods, if the customer has any doubts about the integrity of the goods, he must indicate this on the delivery receipt. The customer will have 14 working days to check the integrity of the goods and notify us in writing by e-mail to info@majnoni.com of any damage. Within 14 working days of receipt of the goods, FATTORIA MAJNONI GUICCIARDINI DI PIETRO MAJNONI E FIGLI SSA will refund the customer.

Right of withdrawal

The Customer has the right to withdraw from the contract, without penalty and without specifying the reason, within 14 calendar days from the delivery of the purchased products, according to fairness and good faith, upon written notice to be forwarded to info@majnoni.com by e-mail to support@originalitalia.it . In the communication, the Customer must indicate the product or products for which he intends to exercise the right of withdrawal.

Products for which the right of withdrawal is requested must be returned using a courier of the customer’s choice, with the cost of return paid by the customer and within 14 calendar days from the date of notification of the decision to withdraw.

FATTORIA MAJNONI GUICCIARDINI DI PIETRO MAJNONI E FIGLI SSA will refund to the Customer all payments received for the product(s) for which he/she has exercised the right of withdrawal (including the original delivery charges) within 14 days of receipt of the products.

Returned products must be undamaged in order to exercise the right of withdrawal. It is recommended that the original packing box be used for shipping.

Guarantees

FATTORIA MAJNONI GUICCIARDINI DI PIETRO MAJNONI E FIGLI SSA guarantees that products equal to those indicated and described on the site will be delivered. Manufacturer’s responsibility applies to all products sold. The manufacturer is also responsible for the truthfulness and completeness of the claims on the packages.

Privacy

The personal data requested when placing the order are collected by FATTORIA MAJNONI GUICCIARDINI DI PIETRO MAJNONI E FIGLI SSA and processed on computer media, in order to meet the obligations arising from the contract concluded with the Customer and will not under any circumstances and for any reason be transferred to third parties. No. 196 of 06/30/03. The data controller is FATTORIA MAJNONI GUICCIARDINI DI PIETRO MAJNONI E FIGLI SSA, in the person who from time to time has legal representation, unless a person in charge is appointed pursuant to Art. 29 of Legislative Decree. n. 196/2003. The customer, at any time, has the right to withdraw consent to the processing of personal data by written notice to be sent to FATTORIA MAJNONI GUICCIARDINI DI PIETRO MAJNONI E FIGLI SSA, at info@majnoni.com . The customer, in accordance with Art. 7 of Legislative Decree. n. 196/2003, has the right to access his or her own data in the manner provided therein. Marketing communications will be sent only with the explicit consent of the Client issued together with the authorization for processing and sending in the online registration form.

Child protection

FATTORIA MAJNONI GUICCIARDINI DI PIETRO MAJNONI E FIGLI SSA does not sell wine or other alcoholic products to persons under 18 years of age. The courier will NOT deliver wine or other alcoholic products to anyone under the age of 18 and may ask for ID to verify age.

Jurisdiction

The sales contract between the Customer and Majnoni.com is concluded in Italy and governed by Italian Law. For the resolution of civil and criminal disputes arising from the conclusion of this distance sales contract, if the Customer is a consumer, the territorial jurisdiction is that of the court of reference of his town of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Florence.
